What is Collaborative Law?
Collaborative family law is a new approach begun by family lawyers to allow clients to divorce and/or separate with respect and dignity.
It is a process which enables clients to divorce constructively and which recognises that the needs of the children come first.
Collaborative law at its simplest allows clients to keep control of the process. Family lawyers and their clients agree in writing to reach settlement without court involvement.
Clients need to work together in an open and transparent manner to resolve children and financial issues arising out of the breakdown of the relationship.
The aim
* To achieve a fair, negotiated agreement on all issues for the benefit of the whole family to enable both Partners to move on in their lives
* To help both parents to maintain their relationships with their children
* To avoid the stress and high financial cost of a lengthy Court dispute
* To reach an agreement which will be embodied in a Separation Agreement or Consent Order once the process has been discussed and agreed.
